Hosting Service

About this Policy
Please read this document carefully.
It is referred to by the Customer Service
Agreement and forms an integral part of that agreement.
Your use of site hosting services provided by Webmarkworld.com and,
or, Webmark New Zealand Limited (in this agreement also referred to as
"Webmarkworld.com", "Webmark",
"company", "our", "we" or
"us") is subject to the terms and conditions of this policy.
The words "you" and "your" in this agreement
mean the individual and, or, organisation who was declared as CLIENT,
or entered as CLIENT on the request for service form, when service was
requested, and also includes a person who generally acts with the
authority of you and, or, your organisation, or on whose behalf
service was requested.
The following policies must be fully complied with at all times to
meet the requirements of this acceptable use policy.
You must also ensure that anybody to whom you provide publishing
access to your Webmarkworld.com hosted site complies with this policy.
Use of Service
Our Site Hosting Service may be used for most types of lawful
business purposes to communicate and conduct business using the
Internet. Because we wish to ensure all customers receive a high
standard of performance, the standard Webmarkworld.com Site Hosting
Service is not available for any purpose that may generate
extraordinarily high levels of traffic or bandwidth volume.
Examples of sites that may not be routinely hosted on a Webmarkworld.com
Site Hosting Service, include, though are not limited to:
Automatically updated News services; Mail servers; Search engine
and directory services including link listing sites; Streaming
video, music or file download repositories; or automatically
updating Web cam services.
If in the opinion of the company the volume of traffic or demands
on bandwidth exceed a manageable level you shall be given the right to
choose another company service more suited to the nature of your
business. Our charge for such service may differ from that originally
quoted.
Please check with us prior to ordering if you think your site may
generate extraordinarily high levels of traffic or bandwidth volume.
The Webmarkworld.com Site Hosting Service may not be used to
promote or sell any Internet Service Provider (ISP) service including
access, site hosting and e-mail without our prior written permission.
Prohibition of publication, or transfer, of Certain Material
All material uploaded to a Webmarkworld.com hosted site must be
legal for publication in the countries of your potential viewers
and the country you connect to the Internet from.
Material of an adult only, sexual or pornographic nature may NOT be
published to, promoted, distributed, or sold from a Webmarkworld.com
hosted site at any time.
Additionally, your site may NOT carry any links to other sites
containing such material. Nor may it carry, or link to, any
distribution list to be used for the sending of unsolicited electronic
mail or other mass mailings.
Any use of our service which is in our opinion questionable, shall
be examined by us and a determination made by a representative of Webmarkworld.com
as to it’s acceptability or otherwise.
If you are unsure about the content you intend publishing, please
check with us prior to ordering.
Intellectual Property
Only original material or copyrighted works for which you have
permission or a license to publish may be uploaded to a Webmarkworld.com
hosted site.
Images, logos, slogans, designs, and literary works obtained from
other web sites may NOT be uploaded to a Webmarkworld.com hosted site
without the express written permission of the original site owner.
Scripts and codes prepared by others have protection of copyright
and may not be used on our services without the permission of the
owner of such copyright.
Privacy
If you intend using your Webmarkworld.com hosted site to collect
personal information then you MUST take steps to ensure people know:
- that information is being collected
- What that information is
- How you intend using it
- Who you may share it with .
Transactions
If you are conducting business transactions using your site, then
you MUST ensure the following information is available to your
customers prior to them being required to commit to a transaction: -
- The name of the merchant they are placing the order with
- The merchant's address, telephone and facsimile number
- The price of the goods or services they are ordering
- When and by what means they can expect delivery.
Other Functions
Scripts that invoke server-based actions beyond the delivery of
stored material may only be installed or run with our permission.
Typically this includes, but is not limited to, all CGI Scripts and
server based database handlers. We can supply a range of pre-approved
scripts to handle many web-based activities. Scripts may be submitted
to us for certification prior to installation. We may charge a fee for
such service.
The Webmarkworld.com Site Hosting Service allows customer scripts
to send e-mail. This feature may be used to send messages in relation
to business transactions, but is not intended for bulk e-mail
transmission from a database uploaded to our servers.
The Webmarkworld.com Acceptable Use Policy for E-mail also applies
to any site or service that has capability to send, receive or
transfer E-mail.
Effect of law: If any provision of this document is found by a
court of competent jurisdiction to be invalid, the parties
nevertheless agree that the court should endeavour to give effect to
the parties' intentions as reflected in the provision, and the other
provisions of the document remain in full force and effect. You agree that
regardless of any statute or law to the contrary, any claim or cause
of action arising out of or related to use of our services must
be filed within six (6) months after such claim or cause of action
arose or be forever barred.
The section titles in this document are included for
convenience only and may have no legal or contractual effect.
